Trade Secrets

Anthology's confidentiality obligations with respect to information constituting a trade secret under applicable law survive the termination or expiration of any agreement until, if ever, such information loses its trade secret protection other than through an act or omission of Anthology.

Defend Trade Secrets Act Notice

Pursuant to the Defend Trade Secrets Act of 2016, individuals will not be held criminally or civilly liable under any federal or state trade secret law for any disclosure of a trade secret made in confidence to a federal, state, or local government official, or to an attorney, solely for the purpose of reporting or investigating a suspected violation of law, or in a complaint or other document filed under seal in a lawsuit or other proceeding.

06 Intellectual Property and Work Product

Where Anthology creates Work Product or Deliverables for Clients, such materials may incorporate Client data and materials. Anthology treats all Client Materials as Confidential Information and uses them only to the extent necessary to perform the agreed Services.

All Work Product created by contractors engaged by Anthology is treated as work made for hire and vests in Anthology or the relevant Client as set out in the applicable agreement. Contractors acknowledge that Work Product containing or based on Client information is subject to the confidentiality obligations set out in their Independent Contractor Agreement.

07 Retention of Information

We retain personal information for as long as is necessary to fulfil the purposes for which it was collected, to comply with our legal and contractual obligations, and to protect our legitimate business interests — including the enforcement of non-solicitation and intellectual property obligations which may survive contract termination.

Tax records and related financial documentation are retained for the minimum period required by applicable IRS and state tax regulations. Background check information is retained only for the period required by applicable law and the relevant Client engagement.
